Personal injury law usually deals with that area of the civil law whereby on person is injured due to the negligence or carelessness of another. Negligence is the failure to exercise that degree of care that the ordinarily reasonable, cautious, prudent individual would have exercised under all the facts and circumstances existing in that particular situation. Negligence may be doing something that the ordinarily reasonable, cautious, prudent person would not have done under all the facts and circumstances existing at that particular time and place. It may also be the failure to do something that the ordinarily reasonable, cautious, prudent person would have done under all the facts and circumstances existing at that particular time and place.
If a person is negligent, he or she is liable to the injured person and has the duty to compensate the injured person for all past, present, and future harm caused by the negligence. The elements that make up the damages a person may recover usually include, but are not limited to, the following:
- The reasonable value of necessary medical care incurred by the injury person in the past;
- The reasonable value of necessary medical care to be incurred by the injured person in the future;
- Fair compensation for the diminution in the injured person's earning power, that is, the loss of his or her capacity to work and earn a living; and
- Fair compensation for physical and mental pain and suffering reasonably probable future physical and mental pain and suffering.
