Expired OffersOne Massachusetts Superior Court indicated that “when parties sign an otherwise binding offer to purchase real estate and subsequently agree, by their words or conduct or a combination of both, to abandon the date previously established for signing a Purchase and Sales Agreement, in the absence of any expression of intent to the contrary, the Offer to purchase remains binding only for a reasonable period of time.” Whether an Offer has expired depends heavily on the facts of each case.
Most real estate purchases begin with the Buyer submitting a written Offer to the Seller. We believe that all Offers should be carefully reviewed by an experienced real estate attorney before they are submitted to the Seller (often, through the Listing Broker). The Offer is a legal document and may lead the parties to unexpected and unpleasant, costly results.
